It’s a well-known fact that quicker the approach towards mediation or settlement, the faster the chances are for the resolution and it results in saving in terms of costs and time while reinstating the good relationship between the mediating clients.
As a process, there is a mediation clause in the agreements which push the parties to solve their issues through mediation. Even, when there is no mediation clause, Justicon always takes the initiative to close issues through mediation. Once the parties agree to mediation, they appear on the date fixed and Justicon acts as a mediator. The role of Justicon is to facilitate the mediation and not to act as a judge and speak of the merits of the case. Thus, the stages involve preparing the paperwork, deciding the date and venue, bargaining or negotiating and ultimately closing at a win-win situation for both the parties. If the parties succeed to close the dispute, the authorized representatives for both the parties shall sign the minutes and any agreement entered into.
If Justicon acts as a lawyer for their clients in mediation, we initially study the issues and advise our Clients about the pros and cons of the mediation. Once the client is satisfied about the commencement of the mediation, we also attend the mediation process and assist our Clients which includes drafting the final settlement deed.
